Misconduct Resolution Meeting

In keeping with the College’s mission to encourage student development, and to foster leadership, service, and creativity, certain policies and community standards have been established to further these educational goals. The student conduct and community standards programs at Bates College are educationally focused at their core, seeking to help students learn from their mistakes and resolve conflicts peacefully, while balancing the needs of the greater Bates and Lewiston-Auburn communities.

In addition to community standards, we support individual health and wellness throughout conduct processes.  We provide college resources and engage in restorative practices that support physical and mental well-being for each student and their community.

The Misconduct Resolution Meeting is used to resolve reports of minor violations of the Code of Student Conduct. Below is an overview of what this resolution process entails:

Below is an overview of what to expect during a Misconduct Resolution Meeting.

  1. Call-In Letter: This letter will be emailed to your Bates email address. This will include instructions on how to schedule your meeting with Misconduct Resolution Coordinator. 
  2. Misconduct Resolution Meeting: This is a meeting between you and a staff member, called the Misconduct Resolution Coordinator. This meeting is a conversation about the incident where you’ll have a chance to share your perspective. The meeting structure is as follows:
    • Introduction
    • Review of Process: A general overview of the meeting and the resolution process.
    • Sharing of Your Perspective: This is your opportunity to share your perspective of the incident. What happened from your point of view?
    • Review of The College Code of Student Conduct: Where does this incident fall?
      • This includes a review of your violation(s)/charge(s)
    • Assessment of Sanctions: This is when the Misconduct Resolution Coordinator will discuss the outcome and next steps.
    • Questions: This is your opportunity to ask questions about the process, meeting, or next steps.
  3. Outcome Letter: This letter will be emailed to your Bates email address. This will include information about your sanctions and next steps.

The Misconduct Resolution Coordinator shall have authority to render decisions in minor cases of misconduct where outcomes of suspension or expulsion are not under consideration.

Sanctions in these cases may include, but are not limited to, warnings, letters to a student’s file, loss of various privileges, referral to support resources, educational sanctions, removal of a student from College housing or dining, paying for damages to property, further educational conversations, further restorative actions or conversations, other required actions, or being placed on Notice.

If the Misconduct Resolution Coordinator makes a decision in a minor case of misconduct that the student found responsible feels is unjustified, that student may appeal the decision to the Dean of Students. The student appealing the decision must submit the appeal in writing to the Senior Associate Dean of Students or their designee within two class days from the time at which the original decision was communicated to them in writing. Requests for appeal may be sent to studentaffairs@bates.edu.

Students may appeal the decision of the Misconduct Resolution Coordinator only on the following grounds:

  1. That the Misconduct Resolution Coordinator violated the fair application of the procedures of the resolution process as outlined in the Code and that such violation may have had a prejudicial effect upon the outcome of the Misconduct Resolution Meeting;
  2. That new evidence was discovered after the Misconduct Resolution Meeting and could not readily have been discovered beforehand and such evidence might have had an effect upon the outcome of the hearing; or
  3. That the penalty imposed upon the respondent is grossly inappropriate.

The Dean of Students or their designee may affirm, reverse, or otherwise modify the original decision of the Misconduct Resolution Coordinator. Decisions will be made by a majority vote of the three members of the Appeal panel. If there is a tie vote, the original decision of the Misconduct Resolution Coordinator will remain in effect.
